RISK ACKNOWLEDGMENT, ASSUMPTION OF RISK AND LIABILITY WAIVER
Paragliding, Gyrocopter and Recreational Aviation Activities

First: Introduction and Parties to This Waiver

This waiver governs the participant’s involvement in one of the recreational aviation experiences offered, organized, coordinated, or facilitated through Tmashi Tourism Trip Organization Company. Depending on the nature of the experience and the role of each party, it may include the following entities and individuals:

• Tmashi Tourism Trip Organization Company, acting as the organizer, coordinator, marketer, or provider of the experience.
• The Sports Aviation Establishment or the operator of the aviation activity, depending on the experience.
• The owner or operator of the aircraft or aviation equipment.
• The captain, flight leader, or pilot responsible for the flight.
• Employees, representatives, collaborators, contractors, and agents affiliated with the parties listed above.

Collectively, they are referred to in this waiver as the “Organizers and Operators.”

Second: Nature of the Activity and Associated Risks

I acknowledge that my participation in the experience is voluntary and that I understand that aviation and aerial adventure activities, including paragliding and gyrocopter flights, inherently involve risks that cannot be completely eliminated or predicted, even when proper safety procedures and regulations are followed.

Such risks may include, but are not limited to:

• Sudden changes in weather conditions and wind.
• Air turbulence and unexpected movement.
• Risks associated with takeoff and landing.
• Emergency or unplanned landings.
• Unexpected technical failures or mechanical issues.
• Terrain-related risks and the nature of takeoff and landing locations.
• Physical injuries or property damage.
• In exceptional cases, serious injury, permanent disability, or death.

I acknowledge that I have reviewed the nature of the activity, understand the risks associated with it, and voluntarily agree to participate with full awareness of those risks, to the extent permitted by the applicable laws and regulations of the Kingdom of Saudi Arabia.

Third: Health Condition and Fitness to Participate

To the best of my knowledge, I confirm that my physical and health condition allows me to participate safely in the experience and that I have not withheld any medical condition, injury, illness, medication, or circumstance that may affect my ability to participate safely.

I undertake to inform the operator or the flight captain before the activity begins of any health condition or circumstance that may affect my safety or the safety of others.

I accept responsibility for the accuracy of the information I provide regarding my health condition and ability to participate.

Fourth: Compliance with Safety Instructions and Authority of the Flight Captain

I undertake to comply with all safety instructions and directions issued by the Organizers and Operators and by the flight captain before and during the activity.

I acknowledge that the captain, flight leader, or pilot responsible for the flight has final authority over all operational and safety decisions related to the flight and may, when necessary:

• Refuse the participation of any person if their participation may affect safety.
• Postpone or change the scheduled flight time.
• Modify the route or duration of the activity.
• Cancel or terminate the flight at any time.

Such decisions may be made due to weather conditions, technical or operational circumstances, security considerations, or any other reason related to the safety of participants.

I also undertake not to interfere with the operation of the aircraft or its equipment, or attempt to control it, except when expressly instructed by the flight captain.

Fifth: Modification, Postponement, or Cancellation of the Experience

I understand that booking the experience or paying the participation fee does not necessarily guarantee that the flight will take place at the scheduled time, as aviation activities depend on safety conditions, weather, and operational readiness.

The operator or flight captain may postpone, modify, or cancel the experience whenever conditions do not allow it to be carried out safely.

In such cases, rescheduling or the handling of fees will be subject to the booking and cancellation policy adopted by the organizer, in accordance with applicable laws and regulations.

Sixth: Assumption of Risk and Limitation of Liability

I acknowledge that I am participating in the experience voluntarily and after being informed of the nature of the activity and its associated risks.

To the extent permitted by the applicable laws and regulations of the Kingdom of Saudi Arabia, I accept the natural and inherent risks associated with this type of activity and agree not to hold the Organizers and Operators liable for damages arising directly from such risks, from my failure to follow safety instructions, or from my own contribution to the occurrence of any harm.

Nothing in this waiver shall be interpreted as releasing any party from liability that cannot legally be excluded or limited.

Seventh: Personal Belongings

I am responsible for safeguarding my personal belongings during the experience, including:

• Mobile phones.
• Cameras.
• Eyewear.
• Watches.
• Electronic devices.
• Any other personal belongings.

I understand that the nature of the activity may expose certain belongings to loss, dropping, or damage. I am therefore responsible for securing them appropriately or choosing not to bring them on the flight when this is more suitable for safety.

The Organizers and Operators shall not be responsible for the loss of or damage to personal belongings except where applicable laws provide otherwise.

Eighth: Photography and Use of Media

The experience may be photographed or recorded for purposes including:

• Documentation.
• Media publication.
• Marketing.
• Websites.
• Social media platforms.

The participant’s image or any footage in which the participant appears may be used for marketing or media purposes only in accordance with the consent provided by the participant in the waiver form.

Ninth: Final Acknowledgment

I acknowledge that I have read this waiver in full, reviewed its contents, and understood the nature of the experience, the associated risks, and the related instructions. I further confirm that the information I have provided is accurate to the best of my knowledge.

I also acknowledge that my participation is voluntary and that I agree to comply with all safety instructions and with the decisions of the operator and the flight captain concerning the safe conduct of the activity.

My handwritten or electronic signature on this waiver constitutes my confirmation and acceptance of all the terms stated herein, to the extent permitted by the applicable laws and regulations of the Kingdom of Saudi Arabia.
